Terms of Use
These Terms of Use govern access to and use of the Thabiti Alliance website, including its pages, forms, documents, information, features and other website-based services.
By accessing or using this website, you are expected to comply with these Terms of Use and with all applicable laws.
These Terms relate primarily to use of the website. Separate agreements, policies or conditions may apply to particular programmes, partnerships, employment, volunteering, grants, donations or other formal relationships with Thabiti Alliance.
1. About Thabiti Alliance
Thabiti Alliance is a public-benefit initiative based in Kenya, established to advance stability, dignity and opportunity for children, families and communities.
Thabiti Alliance's application for registration as a Public Benefit Organisation in Kenya is currently in progress.
Nothing on this website should be interpreted as representing Thabiti Alliance as a fully registered Public Benefit Organisation until the relevant registration process has been completed.
The organisation's registration information will be updated when appropriate.
2. Purpose of the website
This website provides information about Thabiti Alliance, including its mission, intended programmes, governance, safeguarding commitments, organisational development, transparency, partnership opportunities and ways to engage with the organisation.
The website is primarily provided for general information and communication purposes.
Information published on the website does not, by itself, create a contractual, financial or other legally binding obligation on Thabiti Alliance.
3. No automatic entitlement to assistance
Submitting an enquiry, application, nomination, referral, expression of interest or request for support does not create an automatic entitlement to assistance from Thabiti Alliance.
This includes, but is not limited to:
- Education support
- School fees
- Healthcare support
- Food or nutritional assistance
- Family support
- Emergency assistance
- Accommodation
- Grants
- Sponsorship
- Material assistance
- Any other form of financial or non-financial support
Eligibility for support may depend on programme criteria, verification, safeguarding considerations, available resources, geographic coverage, organisational capacity and other approved procedures.
Thabiti Alliance retains discretion, subject to applicable law and its internal governance requirements, to determine whether an individual, household, community or organisation is eligible for a particular programme.
4. Applications, referrals and verification
Where Thabiti Alliance accepts applications, referrals, nominations or requests for support, applicants are responsible for providing information that is accurate, complete and truthful to the best of their knowledge.
Thabiti Alliance may request additional documentation or conduct reasonable verification before making decisions.
An application, referral or request may be declined, suspended, reassessed or discontinued where:
- Information supplied is materially false or misleading
- Required verification cannot reasonably be completed
- Eligibility requirements are not met
- Safeguarding concerns arise
- Circumstances materially change
- Funding or other resources become unavailable
- Programme capacity has been reached
- Continued assistance would conflict with applicable law or organisational policy
- Another legitimate programme-related reason makes continuation inappropriate
Nothing in this section removes any rights that cannot lawfully be excluded.
5. Fraudulent information and misuse of support
Knowingly providing false, altered, misleading or fraudulent information in order to obtain assistance, funding, services or another benefit from Thabiti Alliance is prohibited.
Where fraud or serious misrepresentation is reasonably suspected, Thabiti Alliance may, where lawful and appropriate:
- Suspend the relevant application or assistance
- Conduct further verification
- Request clarification or supporting evidence
- Terminate assistance
- Seek recovery of improperly obtained funds or property
- Refer the matter to relevant authorities
Any such action will be considered in light of applicable law, safeguarding responsibilities and the circumstances of the case.
6. Programme availability
Information about programmes, pilot projects, priorities, activities or future plans reflects the organisation's intentions and areas of work at the time of publication.
Publication of a programme or objective does not guarantee that:
- The programme is currently operating
- The programme is fully funded
- Assistance is available in every location
- Every eligible person will receive support
- A particular programme will continue indefinitely
- A future programme will begin on a particular date
Programmes, locations, timelines, eligibility requirements, funding priorities and activities may change as the organisation develops.
7. No guarantee of future funding or services
Statements about intended programmes, funding priorities, pilot activities, expansion plans or organisational objectives do not constitute a promise or guarantee of future funding, services or assistance.
Thabiti Alliance may revise, postpone, restructure or discontinue programmes where circumstances require it.
8. Safeguarding and beneficiary protection
Thabiti Alliance is committed to protecting children, vulnerable persons and communities involved in its work.
Users of this website must not use information, photographs, videos, stories or other materials published by Thabiti Alliance to:
- Identify a person whose identity has intentionally been protected or anonymised
- Locate or attempt to locate a child or vulnerable person
- Obtain or distribute private information about beneficiaries
- Contact children or vulnerable persons without proper authorisation
- Exploit a beneficiary or their circumstances

- Publish or distribute sensitive information about a beneficiary
- Attempt to discover a beneficiary's home, school, telephone number or other identifying information
- Use beneficiary material for unlawful, exploitative, misleading or inappropriate purposes
Users must also not manipulate, reproduce or repurpose beneficiary material in a way that misrepresents a person, invents facts, creates misleading impressions or undermines their dignity.
Thabiti Alliance may take reasonable protective action where misuse or safeguarding concerns are identified.
Additional requirements are contained in the organisation's Safeguarding Policy.
9. No unauthorised direct contact with beneficiaries
For safeguarding and privacy reasons, Thabiti Alliance does not ordinarily provide private contact information relating to children, families or other beneficiaries.
Visitors, supporters, prospective donors, partners, volunteers and other third parties must not attempt to establish unauthorised direct contact with beneficiaries using information obtained through this website.
Requests to communicate with beneficiaries will be considered only where appropriate and consistent with safeguarding and privacy requirements.
10. Unauthorised fundraising
No person, organisation, business, social-media account, fundraising platform or other third party may use the Thabiti Alliance name, logo, identity, beneficiary stories, photographs, documents or other materials to solicit money without prior authorisation.
No person may create or operate a fundraising campaign in the name of Thabiti Alliance unless the organisation has expressly authorised that campaign.

12. Authority to bind Thabiti Alliance
No employee, volunteer, supporter, consultant, ambassador, local contact or other individual has authority to enter into contracts, make financial commitments, incur liabilities, collect funds, promise assistance or otherwise bind Thabiti Alliance unless that authority has been formally granted.
Statements made during informal conversations, social-media exchanges, meetings, emails, messages or other communications do not automatically create a binding commitment on behalf of Thabiti Alliance.
A binding commitment will normally require appropriate organisational approval and, where necessary, written documentation.

No person or organisation may publicly represent itself as an official partner, sponsor, agent or affiliate of Thabiti Alliance without appropriate authorisation.

Such events may include natural disasters, severe weather, epidemics, public-health emergencies, civil unrest, conflict, government action, banking interruptions, infrastructure failures, communications outages, cyber incidents or other significant events that materially affect operations.

23. Limitation of responsibility
The website is primarily provided for general information.
Nothing on the website constitutes legal, medical, financial or other professional advice.

- Matters outside the organisation's reasonable control
Nothing in these Terms excludes or limits any responsibility that cannot lawfully be excluded or limited.
24. No third-party beneficiary rights
Except where expressly agreed otherwise in writing, information published on this website is not intended to create enforceable rights in favour of third parties.
The existence of a programme description, policy statement, future objective, funding priority or other website content does not, by itself, create a contractual entitlement in favour of any visitor, applicant, beneficiary, donor, partner or other person.

A failure to enforce a provision in one situation does not prevent the organisation from enforcing it later where appropriate.
27. Severability
If any provision of these Terms is found by a competent authority to be unlawful, invalid or unenforceable, that provision may be limited or removed to the minimum extent necessary.
The remaining provisions will continue to apply to the extent permitted by law.
